TERMS & CONDITIONS

All quotations & orders accepted by Agriquip, hereafter called "the company", are subject to our standard terms & conditions of business. 

Agriquip, we, us or the Company
– Tweddle Fabrications Ltd trading as Agriquip, a company incorporated in England and Wales with registered number 04116437 whose registered office is at Hangar K1, Kirkbride, Wigton, CA7 5HP. 

Orders:

  • Confirmation of all orders is required in writing. It is not our policy to commence work without a written order.
  • No responsibility is accepted for goods wrongly supplied where no written order has been given.
  • Where production has begun cancellation will only be accepted by written agreement.
  • Returns will only be accepted by written agreement; a restocking charge and all carriage costs will be applied at the company's discretion.

Pricing:

  • All price lists are subject to alteration without notification.
  • All goods sold are on a price ruling at time of dispatch basis.
  • All prices are subject to VAT at the governing rate. Carriage, subject to VAT, is to be added to all orders.

Payment:

  • Unless a bona fide trading account facility is in place full payment is required with order.
  • Trading accounts become due for full payment by the 30th day of the month following invoice.
  • All goods remain the property of the company until such time as full payment is made.
  • After delivery, but until payment is made, the customer is charged with full care and financial cover for any goods.

Specifications:

  • The company retains the right to alter specifications without notice or consultation.
  • All weights and capacities indicated are approximate.

Delivery:

  • The company accepts no liability for any delay in delivery or any consequence of such delay.

Guarantee / Warranty:

  • All new equipment is warranted for a period of one season, subject to the terms of limited warranty, which follows:
  • LIMITED WARRANTY Tweddle Fabrications of Kirkbride warrant, in accordance with the following provisions below, to an authorised dealer, that such equipment is at the time of delivery to such purchaser, free from defects in materials and workmanship and is fit for the purpose for which it is intended.

Conditions of warranty:

  1. Machine parts not manufactured by the company are not covered by this limited warranty. The company is not liable for any breach of warranty. Parts are subject to the warranty of the original manufacturer and any warranty claim will be taken up with that manufacturer.
  2. Claims for said parts must be submitted and processed in accordance with the individual manufacturer’s instructions.
  3. This warranty will become void if the company thereof uses the product or any part for any purpose other than that recommended. Similarly, this limited warranty shall cease and become void if the product is misused, neglected, damaged or let out without the company's prior consent. The company has the right to determine if the product has been misused, abused or lacked maintenance in any manner mentioned. The company decision will be final.
  4. The company shall not be liable for any damage to the product caused in transit or when handled by any independent carrier or haulier.
  5. The company shall not be responsible for any damages for loss of use or inconvenience due to any unforeseen delay in delivery.
  6. The company is not liable for any loss of earnings, cost of labour or cost of replacement caused by any breakdown of the product.
  7. The company shall not be responsible or liable for any injury caused by the product.
  8. The company shall not be liable for any costs occurred in the removal or replacement of any component.
  9. The customer shall be liable for the following costs and expenses:
    • Maintenance including adjustments to the product which is customary in the business in which the customer and company is engaged. This includes adjustments from time to time to keep equipment in good repair so that it may perform its intended tasks.
    • Dealer travel time to and from the equipment or to deliver and return the equipment for repair.
    • Persons/Dealers/Distributors dealing in the company's products are in no way agents of the company. As such they have no right or authority to assure any obligation to the company.
    • Dealer travel costs or any other costs incurred incidental to deliveries or repairs.
    • This limited warranty will not apply to any product that is altered or modified without the prior written consent of the company.
  10. The company reserve the right to incorporate any changes in design or materials in its products.
